‘Despicable’: Park Service chief dragged before House panel, ripped over closures

The head of the National Park Service was pilloried at a tense House hearing Wednesday over the agency’s allegedly “arbitrary” decisions during the partial shutdown which Republicans charge were made to inflict maximum inconvenience on the public.

“The policies have been arbitrary, inconsistent, and ever-changing,” Rep. Doc Hastings, R-Wash., chairman of the House Natural Resources Committee, said.

He alleged the National Park Service is trying to make the partial shutdown “as painful and as visible as possible.”

GOP lawmakers sharply questioned a string of recent NPS moves, as Director Jonathan Jarvis claimed his agency was trying to comply with the law and make do with limited resources. They questioned why the park service tried to shutter some private businesses on federal land, closed off open-air memorials in D.C. to most public viewing, and even blocked off parking lots.

Rep. Darrell Issa, R-Calif., chairman of the House Oversight and Government Reform Committee, said “punitive measures were taken at no savings to the American people.”

Reacting to a reported internal claim that the park service directed workers to make the cuts as difficult as possible, Issa said, if true, “it is indeed disgusting and despicable that the Park Service would do this.”

Jarvis later called that claim “hearsay.”

Jarvis was compelled with a subpoena to testify on Wednesday. He said he was willing to appear, but wanted to wait until his staff returned from furlough.

In a series of feisty exchanges, Jarvis defended his agency’s actions.

Mutiny: Retired Navy captain plans blockade to protest closure of Florida waters

“As you are well aware,” wrote Retired U.S. Navy, Senior Chief Geoff Ross — in a message posted by Fred Brownbill on Save America Foundation Sunday — the federal government “has illegally and unconstitutionally closed state fishing and navigational waters within the 12 mile boundary of state waters.”

When logging onto the U.S. Department of Interior website, visitors are greeted with this message, posted Oct. 1 by the National Park Service:

Because of the federal government shutdown, all national parks are closed and National Park Service webpages are not operating. For more information, go to www.doi.gov.

As reported by The Associated Press Oct. 1, “President Barack Obama says House Republicans have shut down the federal government over an ‘ideological crusade’ against his health care law.”

Citing Examiner’s report from Saturday – “Feds close Florida oceans: Florida Bay Charter owner says ‘they’re killing us’” — Ross is now calling for “every charter boat fisherman across Florida, Louisiana, Texas and Alabama (who is able) to get his or her vessels ready for underway for a coordinated mission to recover your stolen rights as Americans.”

I want 1000 to 2000 charter boats filling the water way that was closed and confiscated illegally by President Obama under his White House order. DEFY IT ! Its illegal.

“I’m going to fill my waterway with boats,” Ross told Examiner Monday. “Charter boats, rowboats, canoes, kayaks, I don’t care.”

Just fill it. We’re going to fill it.

This will not be the first time Ross has helped organize a show of mutiny over the closing of Florida’s fishing waters.

“I’ve done this before,” Ross said.

On Nov. 7, 2009, more than 100 boats — including about 70 charter boats – gathered to form a blockade of Destin’s East Pass in Fort Walton, Fla. to protest the closure of “snapper season on September 20, 2009 and the amberjack season on October 24, 2009” by the National Marine Fisheries Service.

The flotilla — organized by the Destin Charter Boat Association – was assisted by Ross.

Ross told Examiner that the event was also attended by a couple of Coast Guard vessels.

“But they didn’t try to stop us at all,” Ross said. “They knew I wasn’t going to stand down.”

And now I’m going to do it again.

While Ross said he has already received “quite a few” calls,” he is coordinating with fishing charter boat captains in South Florida’s Hernando County to determine what day would best suit their schedules to launch the new show-of-force blockade.

Ross said it will take about a week to pull everything together.

Ross also told Examiner that he has been discussing the matter with Florida Gov. Rick Scott.

“He’s a good friend of mine,” Ross assured. “I have talked to him personally”

I have sent an action requirement to his chief of staff and they are currently looking at it as we speak.

“I just got off phone with Gov. Scott,” Ross added, “and he’s looking into legal action against Obama.”

After contacting Gov. Scott’s office, Scott’s press secretary — Jackie Schutz – told Examiner by email:

We will get back to you on this.

“The Florida Constitution is very clear in that ownership of all the all navigable waters in the State is in the people as individual State Citizens in their united Sovereignty,” Ross wrote Sunday.

As Ross told Examiner Monday, government shutdown or not, “the federal government has no authority to shut down state waters — period.”

Ross appears to be correct.

Article X, §11 of the Florida Constitution states:

SECTION 11. Sovereignty lands.—The title to lands under navigable waters, within the boundaries of the state, which have not been alienated, including beaches below mean high water lines, is held by the state, by virtue of its sovereignty, in trust for all the people. Sale of such lands may be authorized by law, but only when in the public interest. Private use of portions of such lands may be authorized by law, but only when not contrary to the public interest.

As Ross noted further Sunday, “the Florida Supreme Court spoke to this” by its ruling in the case of Odom v. Deltona Corp. on Nov. 30, 1976.

Feds just pissed off residents of the Great Smoky Mountains

You all know who those folks are right?  We’re talking roots to moonshiners and Davy Crockett here.  Folks like Daniel Boone, and my own Daddy came from “them thar hills”.

The Federal Government is about to get a taste of pissing off the true owners of this country – us.

‘All about power and leverage’ — feds shut down major roadway, block access to graveyard

Folks who live in the Great Smoky Mountains have just about reached their breaking point with the federal government.

“It’s almost like they are pushing to see how far they can push before the American people say enough is enough,” said Ed Mitchell, the mayor of Blount County, Tenn. “We were founded on a declaration of independence. And they are about to push the people to the line again.”

Nearly a third of Blount County is inside the Great Smoky Mountains National Park. So when the federal government shut down the park, it also shut down one of the area’s chief sources of revenue.

The National Park Service also closed the Foothills Parkway, a major thoroughfare in the county. The closure came without warning and left the local school district scrambling to get children back to their homes.

At what point do you say to heck with the feds?

The children live in the eastern Tennessee community of Top of the World – serviced by School Bus 49. Normally, the bus travels along the Foothills Parkway. Other roads leading to the isolated mountain community are impassible by bus.

“It’s dangerous,” said Nancy Kemp, the spokesperson for Blount County Schools.”It’s very curvy and straight up the mountain. It’s just not a safe route.”

One local resident told Knoxville television station WBIR that the alternative roads are “white knuckle routes.”

The closure caught locals by surprise and left the school district scrambling to alert parents that they would need to find a way to get their kids back home. And until the partial government shutdown ends, school buses will not run. That means parents will have to transport their children to and from school using treacherous “white knuckle routes.”

“I’ve already talked with some of our neighbors (and) we’re going to be carpooling,” resident Danielle McClurg told the television station. “It’s going to be very inconvenient for our community.”

Resident Buzz King said the shutdown of the Parkway has already created hardships for the mountain town.

“It’s going to be tough on people up here – definitely tough,” he said.

Local businesses are also facing tough times.

“Twenty-eight percent of the park is Blount County,” the mayor told me. “And this is the busiest season for us – when the colors are changing.”

And so long as the shutdown is in effect – that means no fishing, hiking, horse-back riding, or camping inside the park.

“That’s a slap in the face to the American people,” Mitchell said. “They should have never, ever let this happen.”

One of the areas shut down is the popular Cades Cove – an old community that was donated by local residents to the federal government some 75 years ago, the mayor said.

“Hundreds of families gave up that land, packed up their stuff and moved out to give the country that park,” he said. ‘Now, they’re watching the government shut the gate on it.”

Even more insulting is the National Park Service won’t allow family members to visit old grave sites.

“Some of them have family members buried there,” the mayor said. “And they go and visit every week at the churches still in the cove. They are not able to do that.”

It’s gotten to the point where Mayor Mitchell said Americans are ready to start fighting back.
“It’s almost like they are pushing to see how far they can push before the American people say enough is enough,” he said.

They almost crossed that line in Blount County.

The mayor sent a letter to the Department of Interior and copied the area’s congressional delegation. The letter detailed a plan that would allow the local government to take control of the park until the federal shutdown ended.

“We were willing to open that park up at no cost to the federal government,” he said. “We worked out a plan. That park could be running today just as efficiently as if the federal government had it up and running.”

He never heard back from the feds or his state’s congressional delegation.

“I’m not so sure any of them care anymore,” said the self-identified conservative Republican mayor. “Before you start hearing from the federal government, something has to happen to make them care.”

Local residents have become so frustrated they actually devised a plan to circumvent the feds.

“We already had the codes on the gates and we were getting ready to open it up without notifying them,” the mayor said. “Wiser heads prevailed.”

Military Priests Face Arrest for Celebrating Mass in Defiance of Shutdown

Our government is out of control.

First, it was the World War II veterans who had to break down barriers to see the open air, un-attended memorial erected in their honor.  A memorial which is on public land but is supported – including the National Park Service fee – with private funds. This week there was more security surrounding this memorial — just to keep elderly veterans out — than there was at our embassy in Benghazi the night it was attacked.

And for what? To inflict as much pain as possible through this government shutdown. It’s called Washington Monument Syndrome, and it’s pure political theater.

But now there’s a story just coming to light that takes things even further. According the Archdiocese for Military Services, GS and contract priests (who are paid by the federal government as independent contractors in places where there aren’t enough active-duty priests to meet the needs of Catholics in military service) are being forbidden from celebrating Mass, even on a volunteer basis.

If they violate this restriction, they face possible arrest. FOR CELEBRATING MASS.

There is a chronic shortage of active duty Catholic chaplains. While roughly 25% of the military is Catholic, Catholic priests make up only about 8% of the chaplain corps. That means approximately 275,000 men and women in uniform, and their families, are served by only 234 active-duty priests.  The temporary solution to this shortage is to provide GS and contract priests.   These men are employed by the government to ensure that a priest is available when an active duty Catholic Chaplain is not present.  With the government shutdown, GS and contract priests who minister to Catholics on military bases worldwide are not permitted to work – not even to volunteer.  During the shutdown, it is illegal for them to minister on base and they risk being arrested if they attempt to do so.

As an example, if a Catholic family has a Baptism scheduled at the base chapel at Langley AFB this weekend, unless they can locate a priest who is not a GS or contract priest, they should consider it cancelled.   Likewise, a Marine who attends Sunday Mass at the Quantico Chapel will have to go elsewhere this weekend.  If you are a Catholic stationed in Japan or Korea and are served by a Contract or GS priest, unless you speak Korean or Japanese and can find a church nearby, then you have no choice but to go without Mass this weekend.  Until the Federal Government resumes normal operations, or an exemption is granted to contract or GS priests, Catholic services are indefinitely suspended at those worldwide installations served by contract and GS priests.

At a time when the military is considering alternative sources of funding for sporting events at the service academies, no one seems to be looking for funding to ensure the Free Exercise rights of Catholics in uniform. Why not?

Maximum Pain to the People

If anyone still thinks the administration isn’t doing everything possible to cause maximum suffering during the shutdown, take a look at this.

The National Park Service WEBSITE has been shut down. That’s right, a static website that can just sit there and be a website.

Folks this is the biggest load of bullshit you’ve ever been fed.  Shutting down the government doesn’t STOP web sites from working, telephones from ringing or people going to work to shut down parks that aren’t even guarded in the first place.

Every time these bastards open their mouths to “Blame” the other side, it’s a lie.  This was set up to make Americans “feel the pain” so they would complain and get the ‘government back online’.

Won’t stop welfare.  Won’t (or shouldn’t) stop Social Security checks.  There are NO cops guarding the WW II Memorial (and it was built with private funds BY THE WAY).

Hell even “Good Will” went home at the Air Force Academy yesterday on “furlough” and they aren’t even government workers.

The Air Force vs Navy game is on (because someone put up the 200k+ funds as a private donor) and Army is playing Saturday as well – and guess what?  The MONEY for the Academies are ALREADY ALLOCATED INCLUDING SPORTS!

This is all the biggest load of bullshit you’ve ever been fed.

I’m rushing this post out because, per Ed’s stellar round-up from earlier this morning, the Honor Flight vets are headed to the Memorial regardless. Members of Congress, among them Michele Bachmann, are already there, as are reporters of all stripes. If you use Twitter, I recommend following the Standard’s John McCormack, National Review’s Betsy Woodruff, and the Examiner’s Charlie Spiering, who took the photo I used for our front-page thumbnail of the feds actually deploying forklifts to set up gates around a memorial that’s open 24 hours a day with little supervision under normal circumstances. As I write this at a few minutes after 10:30 ET, Spiering is tweeting that the vets are scheduled to arrive within the next 15 minutes. Is your government really about to arrest 96-year-olds who fought at Guadalcanal because this bit of sub-moronic shutdown theater is too precious to them to forfeit? Stay tuned. It wouldn’t be the first own-goal they’ve scored because their pettiness overwhelmed their sense of optics.

By the way, the WWII Memorial isn’t the only one with a gate in front of it this morning. When McCormack strolled over to the World War I Memorial, he found this. No joke:

The sign reads, “Because of the federal government shutdown, this National Park Service area is closed, except for First Amendment activities.” So if you want to protest there, you’re good. If you want to quietly remember the dead, get off the damned lawn.
